Doc.

【Statement on the Mass Arrest under Article 22 of the National Security Law】
We, the undersigned, as legal practitioners who firmly believe in the Basic Law and the rule of law are deeply concerned that more than 50 pro-democracy lawmakers, activists and lawyers, were arrested yesterday for alleged subversion under Article 22 of The Law of the PRC on Safeguarding National Security in the HKSAR (“NSL”) for organising and/or participating in a primary election for candidates in the 2020 Legislative Council election.
At the press conference on 6 January, Senior Superintendent Steve Li confirmed that the Police had searched 72 premises with a warrant, including a law firm. No satisfactory explanation, however, was given by the authority at the press conference as to why Article 22 of the NSL was invoked in respect of these activities, when that provision expressly requires as an essential element of the offence the use of “force or threat of force or other unlawful means”. The organisation and conduct of the primary election did not involve any violence or other unlawful acts.
The right to participate in public affairs, irrespective of one’s political opinion, is enshrined under Article 25 of the International Covenant of Civil and Political Rights and also protected under article 21 of the Bill of Rights Ordinance (Cap.383). It also plays a crucial role in the promotion of democratic governance and is fundamental to the rule of law in Hong Kong. Therefore, we strongly oppose and condemn any attempts to suppress peaceful exercise of the fundamental human rights enshrined in the Basic Law.
We note that back in March 2003, when the NSL was introduced, the Security Bureau still acknowledged the need for the national security legislation to be consistent with the Johannesburg Principles. Principle 2 of the Johannesburg Principles on National Security, Freedom of Expression and Access to Information, Freedom of Expression and Access to Information (U.N. Doc. E/CN.4/1996/39) provides that “A restriction sought to be justified on the ground of national security is not legitimate unless its genuine purpose and demonstrable effect is to protect a country's existence or its territorial integrity against the use or threat of force, or its capacity to respond to the use or threat of force, whether from an external source, such as a military threat, or an internal source, such as incitement to violent overthrow of the government.”
We call upon the Government to explain whether it has abandoned any due regard to the Johannesburg Principles and the fundamental rights guaranteed under the Basic Law, including the freedom of expression and assembly.
As lawyers, we are further troubled by the search of a law firm, which could violate the fundamental right of residents to legal advice as set out in Article 35 of the Basic Law. We urgently urge the authorities to exercise restraint, to ensure effective protection to legal professional privilege, and to fully uphold the right to political participation for all Hong Kong residents.

[How #Beiing treats #ClimateStrike at home]
https://twitter.com/joshuawongcf/status/1310220073865535488
1. While #China claims to reach carbon neutrality by 2060, it is better for the world to draw attention to how this world’s biggest carbon emitter actually treats green activists at home.
2. Brave teen activist @howey_ou told @VICE, she was once taken to #police station after calling for #ClimateAction outside local gov offices. During interrogation, cops asked her about how she knew about #ClimateChange, why she protests every day and all ppl who had talked to me
3. She described green activism isn’t welcome at home when public criticism is viewed as acts of defiance and harshly punished, "It’s all about authority. They weren’t concerned about science or the planet at all.”
4. "They also seemed to know a lot about me and even had details about my friends — that was when I knew it wasn’t an innocent chat. I finally understood that these were officers from the national security bureau and realized that it wasn’t a casual arrest," she said.
5. Upon her release, she lost internet connection at home, barred from posting on Twitter, banned from school and restricted from talking to foreigners or journalists. While her phone number was suspended, police also phoned her parents for several days at their workplace.
6. Unlike other gov-funded NGOs that dare not challenge gov, Howey is excluded from events abt climate change in #China. While #Beijing silences scientists & hides facts from public, Chinese companies are allowed to destroy nature & many don’t care abt it nor believe in science.
7 When #China promises to take action, its tolerance on green activism is litmus test of its willingness to implement the plan.Don't forget China's 2015 documentary #UnderTheDome on air pollution was banned within a week after unveiling failure of Chinese regulations on pollution

[Oct 14: Statement by the families of the 12 Hongkongers: Demand for immediate response]
It has been 53 days since the 12 Hongkongers were sent to China, yet no news has been received by their families so far. On October 13, one of the family-appointed lawyers Lu Siwei, was informed by the Yantian Public Security Bureau that the arrested people had appointed two other lawyers, but they refused to disclose the identity of the lawyers to their families. The Chief Executive Carrie Lam is currently travelling to Shenzhen to meet President Xi Jinping. If Carrie Lam still regards herself as the Chief Executive of the people of Hong Kong, there is no reason for her to turn a blind eye to the life of the 12 Hongkongers and shall speak up for them. We hereby request Carrie Lam to escalate the issue of the illegal incommunicado detention of the 12 Hongkongers to Xi Jingping, and seek for direct pressure on the relevant bureau in Shenzhen to investigate and disclose the current situation of the 12 Hongkongers, as well as the information of the “government-appointed lawyers”.
The Chinese authorities have repeatedly used different excuses to refuse the family-appointed lawyers, and now they have even assigned "government-appointed lawyers" to the 12 Hongkongers. The families have no knowledge of the name of the government-appointed lawyers and thus no update of their family members can be inquired therein. The families believe that the Hong Kong Government must have a channel to find out the names of the lawyers whom the 12 Hongkongers were forced to accept, and the Government must disclose this information to the family members and the public.
The case of the 12 Hongkongers is not only a matter of public interest for Hong Kong as a whole, but has also become the international human rights issue. Given that the Chinese Authorities have always been proud of their "sunshine justice", they shall not shy away from the case of the 12 Hongkongers and refrain from responding to Hong Kong people and the international community.
Instead of continuing to treat the arrested Hongkongers inhumanely and further damaging the reputation of China's judicial system in the international arena, the Chinese authorities should take this opportunity to show the world the fairness and impartiality of their "sunshine justice".
The demands of the 12 families are as follows:
Releasing the list of government lawyers assigned to the 12 Hongkongers;
Release radar records to account for the police's role in the incident; and
Direct meeting with Hong Kong Government Officials.
The Hong Kong Government has persistently lied to the families and public, using "jurisdiction" as an excuse to evade and shirk their responsibilities. The families of the 12 Hongkongers will not give up in finding the truth and will fight for the expeditious return of the 12 Hongkongers. Despite the fact that the families are in great pain that 12 Hongkongers might be facing inhumane torture, they are still proud of the 12 Hongkongers who care about Hong Kong and place Hong Kong above their own safety. They are also convinced that the 12 Hongkongers will continue to persevere behind bars until the day they return to their homeland.
